CMO 37 Takes Effect
The Court enters CMO 37, establishing mandatory documentation requirements for all active AFFF/PFAS cases in MDL No. 2873. A 14-day cure mechanism applies to every deficiency notice served.
First Deficiency Notices Issued
Defendants begin serving Category 1 (PFS not submitted) notices across MDL 2873. Each notice opens a 14-day cure window immediately upon service.
First 14-Day Cure Windows Close
The initial wave of Category 1 cure windows expires. Cases that failed to cure face show-cause orders and potential dismissal with prejudice. Notices continue to roll.
Category 1 Notices Still Rolling
New Category 1 notices continue to issue daily. Each opens a fresh 14-day window.
Verification form no longer required.
Submitting completed data collection is now sufficient to cure a Category 1 deficiency.
Category 3 & 4 Begin Issuing
Defendants are now issuing Category 3 (missing medical records) and Category 4 (records insufficient to support alleged injuries) notices.
Category 4 notices are deliberately vague. We've seen enough of them to move fast and keep your cases alive.
Dual Representation Case Report Released
Approximately 7,000 cases have been identified with dual representation concerns. Resolution will require coordination between the involved firms and the establishment of mutually agreed-upon processes for handling affected cases.
